Yes, you can write your own separation agreement in Ontario. There’s no law requiring a lawyer to draft it. But whether a DIY agreement will actually protect you is a different question.

What makes a DIY separation agreement valid

Under Ontario’s Family Law Act, a separation agreement must be:

  1. in writing,
  2. signed by both spouses, and
  3. witnessed.

If those formalities are missing, the agreement may be unenforceable. Meeting them doesn’t guarantee it will hold up, though.

When a DIY agreement can be set aside

A court can set aside all or part of a separation agreement if, for example:

  • a spouse didn’t disclose significant assets or debts;
  • a spouse didn’t understand the nature or consequences of the agreement; or
  • there was duress, unfairness or another problem recognized by contract law.

Courts can also override child support that’s below the Guidelines without good reason, and parenting terms that aren’t in the children’s best interests.

The biggest risks of writing your own

  • Vague wording that leads to future disputes.
  • Missing issues, like pensions, insurance, debts or tax.
  • Pension division mistakes. Dividing a pension often requires specific steps with the plan administrator.
  • Unfair spousal support releases that a court may later revisit.
  • No independent legal advice, making it easier to challenge.
  • Using non-Ontario templates with the wrong legal concepts.

Do you need a lawyer for a separation agreement?

Not legally, but it’s wise to involve one, especially if you have:

  • children;
  • a home, pensions or a business;
  • significant debts;
  • a big difference in incomes; or
  • any spousal support question.

At a minimum, each spouse should get independent legal advice on the final draft.
