You don’t need to stand in line at a courthouse to start your divorce. Ontario lets you file a divorce application online with the Superior Court of Justice. Here’s how the e-filing process works, step by step.
Before you start
Have these ready:
- Completed and signed Form 8A (Application (Divorce)), saved as a PDF.
- Your marriage certificate scanned clearly (with a certified translation if needed).
- A payment method for the $224 filing fee, or your approved fee waiver.
- An email address where court notices can be sent.
- For joint applications: both spouses’ signatures on the application.

Step 1: Go to Ontario’s online family court filing service
Start from the Ontario government’s “File family court documents online” page on ontario.ca, which links to the current online filing portal. You’ll create an account or sign in.
Step 2: Choose to start a new case
Select the option to start a new family case and indicate that you’re filing a divorce application. Choose the Superior Court of Justice location for the area where you or your spouse live.
Step 3: Enter the case details and upload documents
You’ll enter information about the parties and upload your signed Form 8A and supporting documents. Check that every file is legible and complete.
Step 4: Pay the filing fee
Pay the $224 filing fee electronically ($214 provincial plus the $10 federal divorce registry fee). See divorce application fees.
Step 5: Receive your issued application
The court reviews your submission. Once accepted, you receive your issued application with a court file number. Keep it safe; you’ll need it for every later step.
Step 6: Serve your spouse (sole applications)
For a sole (simple) application, a process server personally serves your spouse with the issued application and completes Form 6B: Affidavit of Service. Your spouse has 30 days to respond (60 if served outside Canada and the U.S.). Joint applications skip this step.
Step 7: File the affidavit for divorce
When you’re ready, file Form 36: Affidavit for Divorce and Form 25A: Divorce Order, plus your marriage certificate and any child support information, and pay the $445 set-down fee. A judge then reviews the file.
