Form 8A for a simple divorce
In a simple divorce, you fill out Form 8A as the applicant and name your spouse as the respondent. You’ll indicate that this is a simple application asking for a divorce only. The form covers:
- your and your spouse’s details;
- the date and place of marriage;
- the ground for divorce (usually separation, with your separation date);
- residence in Ontario for at least one year;
- details of any children; and
- what you’re asking for (divorce, and possibly costs).
Form 6B: Affidavit of Service
After the court issues your application, a process server (not you) personally serves your spouse and swears Form 6B describing how and when service happened. You file it with the court. It’s the proof the judge needs that your spouse knew about the case.
Form 36: Affidavit for Divorce
Once the response period ends (30 days, or 60 if your spouse was served outside Canada and the U.S.), you swear Form 36. It confirms the facts in your application, the separation, that there’s no chance of reconciliation, and, if you have children, the child support arrangements. The judge relies on it to grant your divorce without a hearing, so it must be complete and accurate.
Form 25A: Divorce Order
This is the draft order. The court typically asks for copies and stamped, addressed envelopes so the signed order can be sent to both spouses.
