The Two Mandatory Court Fees
An uncontested divorce in Ontario involves two separate court filing fees. Both must be paid to the court; neither can be skipped (unless you qualify for a fee waiver).
1. Filing the Divorce Application — $224
When you file your divorce application (Form 8A) with the Superior Court of Justice, you pay a fee of $224. This breaks down as:
- $214 — Ontario provincial court fee (payable to the Minister of Finance)
- $10 — Federal divorce fee (payable under the Divorce Act, retained even if a fee waiver is granted)
This fee is paid at the time of filing, either in person at the courthouse, by cheque made out to "Minister of Finance," or online through select court portals. Joint applications (where both spouses file together) are subject to the same fee.
2. Setting Down for Divorce Order — $445
The second mandatory fee of $445 is paid when you file the requisition to set the matter down for a divorce order. This is done after the response period has passed (or jointly, after completing the affidavit for divorce). The judge reviews the file and, if satisfied with the application, signs the divorce order.

Optional Fee: Divorce Certificate — $25
