3. Separate and apart. A statement that you live separately, and that neither will interfere with the other.

4. Parenting. Who makes major decisions (decision-making responsibility), the regular parenting schedule, holidays, travel and how changes are handled.

5. Child support. The paying parent’s income, the monthly table amount under the Federal Child Support Guidelines, special or extraordinary expenses, and annual income disclosure.

6. Spousal support. Amount and duration, or a mutual release, and whether it can be reviewed.

7. Matrimonial home. Who keeps it, whether it’s sold, how proceeds are divided, and who pays the mortgage until then.

8. Other property and equalization. Division of bank accounts, vehicles and investments, and any equalization payment between married spouses.

9. Pensions and RRSPs. How retirement savings are divided, including any pension division through the plan administrator.

10. Debts. Who is responsible for each debt, and protection if the other spouse doesn’t pay.

11. Insurance and benefits. Life insurance to secure support, and health benefits for children.

12. Taxes. Tax treatment of support and who claims dependants.

13. Releases. Each spouse’s release of other claims, if appropriate.

14. Dispute resolution. How you’ll resolve future disagreements, such as mediation before court.

15. Financial disclosure and legal advice. Confirmation that each spouse disclosed finances and had the chance to get independent legal advice.

16. Signatures and witnesses.
